Labor Relations Research Paper

MG420 DL Labor Relations Research Assignment (Arthur Crump) (September 27, 2009) Professor Stroud 1. Define and discuss the term â€Å"collective bargaining. † Include and discuss [showing relevance or applicability] a current web-based news item/magazine article about a real life example of a collective bargaining action. Write a succinct and complete summary on the contents of the article you've provided along with your critical comments about that article. Support your findings with referenced research. (5 points) The Honolulu Advertiser recently published an article which cites on-going contract bargaining negotiations between the University of Hawaii (UH) Professional Assembly (who represents the faculty) and UH (http://www. honoluluadvertiser. com/article/20090918/news07/909180373). Currently, negotiations are at a stale-mate due to UH submitting its final contract offer to the UH Professional Assembly asking for a 5% pay reduction as well as a 10% reduction in the state’s contribution to their health insurance premiums. Due to this final offer issuing an ultimatum stating that the university will be â€Å"unilaterally imposed if not accepted by the union,† may force the union â€Å"to take legal action or strike. † The reasons cited by the university for their terms are despite increased enrollment, they’ve experienced significant budget reductions. This article is a great example of collective bargaining because the faculty is afforded the opportunity to have some efficiency, equity, and voice (Labor Relations, pg. -12) regarding their work terms. Additionally, this article also displays the definition of multilateral bargaining which is negotiating between multiple parties which in this case include: Board of Regents, the UH president, and the State’s Governor (Labor Relations, pg 296) Unfortunately this particular case is affected by the economic element for the bargaining environment due to the reduced budget cuts. (Labor Relations, pg 286) 2. Identify three laws that support collective bargaining. Include and discuss [showing relevance or applicability] a current web-based news item/magazine article about each. Write a succinct and complete summary on the contents of the article you've provided along with your critical comments about that article. Support your findings with referenced research. (30 points) The National Labor Relations Act of 1935, also known as the (Wagner Act), supports collective bargaining by eliminating the disparities in equity between Labor and the Employer, as well as protects labor’s right to unionize should they so desire. This law was initiated due to previous legislation being ruled unconstitutional, and placed more emphasis on law for private sector labor. (Labor Relations, pg 166) The following link: http://stlouis. bizjournals. com/stlouis/stories/2009/08/03/daily52. html cites an article about the Lumiere Place and President Casino of violating labor laws recognizing the employee’s union as their bargaining agent by the regional National Labor Relations Board (NLRB), office in St. Louis. After reviewing this article in its entirety, this case evolved over an issue resulting from a misunderstanding by the employer as to the exclusive representation of the majority of employees, and the employer’s stance appears to stem from this requirement of the Wagner act. Another law designed to support collective bargaining and protect union members’ from corruption from its union leaders is the Landrum-Griffin act. A perfect violation of this law is the City of New York against New York City’s Carpenter’s union. See ad link at: http://www. nytimes. com/2009/08/06/nyregion/06indict. html. The union’s leadership is accused of accepting bribes by allowing contractors to rip off the workers, and in return, the union leadership would overlook these offenses and provide no representation which is totally contradictory to the purpose of union affiliation. The third law which supports collective bargaining is the Railway Labor Act. This law considered a win-win to both the labor and employers. It is considered a win to labor because it allows them to have bargaining rights despite being in an interstate industry which requires the employees to â€Å"work now and grieve later† concept: (http://www. papilot. org/media/rla. asp#What%20is%20the%20Railway%20Labor%20Act). As far as Employers and the Public, Congress implemented this act to protect the employer’s, employees, and the public’s interest since rail was the main transportation of the day, and any disruptions due to strikes would have had an adverse impact on interstate commerce as a whole. Th is law also covers parcel drivers for UPS and FedEx, but an amendment to the law was introduced to amend the law as it is now, to only limit individuals who hold an FAA-certified job. FedEx feels this would have a negative impact on its operations in the event of a strike by removing the work now grieve later concept from its other driver employees, and revert them back to the National Labor Relations Act. (http://www. joc. com/node/409948). 3. List four issues that are potential components of a collective bargaining agreement. Pick any two of the four issues you’ve listed and include and discuss [showing relevance or applicability] a current web-based news item/magazine article about each of those [two] collective bargaining issues in action. Write succinct and complete summaries on the article. Support your findings with referenced research. (18 points) The four issues that primarily make up a bargaining agreement consist of wages, benefits, layoff policies, and grievance procedures. Regarding wages and benefits, the following link refers to an article where an individual incurred an eye injury toward the end of his contract with the cruise line, and simultaneously, the cruise line which he worked for was undergoing a merger with another cruise line. The problem for the employee occurred because while he was out from work and the merger on-going, he felt that he was entitled to wages for the time which he was away due to obtaining surgery (sick leave). Since his contract expired 3 Oct 97, the district court which presided over the case ruled that due to the member’s closely approaching contract expiration date on or about 3 Oct 1997 in relation to the date of injury, he was not entitled to sick pay. Additionally due to the collective bargaining agreement in effect at the time of this member’s injury, the member was entitled to 63 days sick leave with pay under the original agreement. Since there was confusion as to which agreement was in effect due to the merger, this particular case was ruled in favor of the employer, and the employee wages claim for sick leave was denied. Definitely an unfortunate outcome for the employee since he was temporarily incapacitated from seeking additional employment, and hopefully a learning experience to have input with any future employment involving collective bargaining. (http://www. accessmylibrary. com/article-1G1-78635159/royal-caribbean-cruises-properly. html) 4. Describe the process of establishing a bargaining unit. Include and discuss [showing relevance or applicability] two current web-based news item/magazine article about any part of the process of establishing a bargaining unit. Write a succinct and complete summary on the contents of the article you’ve provided along with you critical comments about that article. Support you finding with reference research. (5 points) Establishing a bargaining unit has 8 steps each for both the employer and the union. The eight steps for the union consist of As capitalism continues to globe trot across China’s landscape, China is racing to establish unions in all fortunate 500 companies located there. Their recent accomplishment of setting up workplace unions in supposedly non-union Wal-Mart, led to them wanting to set up unions in at least 80 percent of the aforementioned companies and branches. Their current time-line calls for 10,000 workplaces to have new unions within 100 days. Additionally they are using a pattern bargaining structure from their Wal-mart feat (Labor Relations pg 291), in order to accomplish this enormous task. http://www. clntranslations. org/article/33/the-chinese-trade-unions-big-rush-to-set-up-unions-in-fortune-500-companies Two years after the All China Federation of Trade Unions (ACFTU) accomplished a breakthrough to set up workplace unions in Wal-Mart stores, on 11 June this year, after holding a meeting in Beijing, it announced that it would immediately launch a campaign to set up unions in at least 80 percent of the Fortune 500 company headquarters and branches. Up until now only some 50 percent of these companies have unions. This means that, including unions in these company’s branches, more than 10,000 workplaces have to have new unions. This ‘100-day focused action’ as the ACFTU calls it, will be in high gear until the end of September. The announcement was made with a sense of urgency and determination. Local unions were also instructed to take legal action against any companies that refuse to accept having a union. 1 It would have been a tall order had this union federation edict been issued in a country where there is freedom of association, especially in a place like the United States where unionization is met with stiff resistance and where labor laws and unionization procedures make setting up workplace unions extremely difficult – if not impossible. But using the establishment of the 100 Wal-Mart trade unions as a template, this is a feasible mission. After initially using the secretive method of setting up unions at about a dozen Wal-Mart stores (see http://www. clntranslations. org/article/4/wal-mart), the ACFTU abandoned this new organizing method and reverted to using the ‘consultative’ method, that includes management in the setting up of the union preparatory committee and the subsequent election process. The new grassroots unionization method used for the first dozen Wal-Mart stores is time consuming and may end up with elected trade union executive committees and chairpersons making demands on the company. The ACFTU has always been using the ‘above-ground’ method which, in their view, has stood the test of time. In light of the ACFTU’s goal to set up more than 10,000 workplace unions within three months, it can be safely predicted that these unions will be heavily dominated by management. To illustrate what these new Fortune 500 trade unions will probably be like, CLNT has chosen to translate a report form the Suzhou Daily, 8 July 2008, which is a transcript of a round-table discussion by 10 workplace trade union staff members from some Fortune 500 companies that have already had trade unions. They talked about their experiences and offered their own opinions on what ideal trade unions chairpersons should be. There was a consensus that the union is to be a channel of communication between workers and management, that the trade union chair should have the ability to use a common language to talk to both parties, that the union is the agent for a win-win situation for the

Women in Psychology

Abstract It is safe to infer that the study of psychology is ever changing and advancing in many facets. This advancement is due to the many physiologist, theorist, psychologist, and scientist that have dedicated their beings to studying of the human mind and human behavior. Amongst these professionals, stand some very influential women. These women have played very important and often key roles in the development of psychology as we know it today.I will highlight the contributions of some major roles females have played in psychology, and conclude by discussing the contributions of Americans first female psychologist Christine Ladd-Franklin, her background, and theoretical perspectives of psychology. Women in Psychology Psychology as we know it today is the study or science of the human mind and behavior. Psychology up until 1870 was a branch of philosophy and then developed as an independent scientific discipline. In 1879 began the study of experimental science with Wilhelm Wundt i n Leipzig. This marked a historic and very important moment in psychology. Though Wundt is the first to experiment with psychology, there were also others who followed very closely. Charles Peirce, particularly, who was the first American experimental psychologist, also had a major contribution. In Charles Peirce journey in psychology, he worked very closely with Christine Ladd-Franklin, who later became the first woman involved in the three disciplines: logic, psychology, and mathematics.Although we don’t hear much about women and their involvement in psychology, some women offered some major contributions to the field of psychology between 1850 to present day. Psychology as we know is the study or science of the human mind and behavior. Although we don’t hear much about women and their involvement in psychology, some women offered some major contributions to the field of psychology between 1850 to present day. Women such as Mary Whiton Calkins, Maria Montessori, Marga ret Floy Washburn, Karey Horney, Christine Ladd-Franklin, and Anna Freud had significant contributions to the field of psychology. Some contributions include, but are not limited to such as paired associate techniques, â€Å"Children’s House† for â€Å" psych- pedagogy,† which is an educational method for child psychology, the founding of â€Å"The Association for the Advancement of Psychoanalysis† as well as the Hampstead Clinic, a treatment center for child psychology. These women had great accomplishments in the world of psychology. However, for the purposes of this paper, I will be discussing the workings and contributions of Christine Ladd-Franklin.Christina Ladd-Franklin was born in 1847. She attended Vassar studying mathematics, since the field of physics (her primary interest) was not available to women. She later attended John Hopkins University, where she completed the requirements for her PH. D, but due to the fact that women were not allowed to graduate from the University, she was not given her PhD until years later. Ladd’s dissertation paper was written on the â€Å"Algebra of Logic,† and she became the very first women involved in psychology, mathematics, and logic.Once Ladd left Hopkins, she worked side by side with G. E. Mà ¼ller who worked on memory activity, the mathematical prodigy, color vision, and also his analysis of the method of introspection. Ladd was very interested in Mà ¼ller’s study on color vision, and in turn proposed her own color vision theory. In part she suggested that â€Å"some animals are color blind and assumed that achromatic vision appeared first in evolution and color vision came later. She assumed further that the human eye carries vestiges of its earlier evolutionary development. She observed that the most highly evolved part of the eye is the fovea, where, at least in daylight, visual acuity and color sensitivity are greatest. Ladd-Franklin assumed that peripheral vision (provided by the rods of the retina) was more primitive than fovea vision (provided by the cones of the retina) because night vision and movement detection are crucial for survival ( Hergenhahn, B. R. 2009.. † She further stated that color vision evolved in three stages, the black and white stage, the blue -yellow stage, nd the red –green stage. She suggested that more people suffered with red-green color blindness because it was the last to develop. Her theory was controversial, but it slowly gained partial acceptance. Ladd reportedly had involvement in the â€Å"Purkinje phenomenon,† that was developed by Hermann Ebbinghaus when she was working in his laboratory. In her later years, Ladd became an advocate for women’s suffrage and assisted in the development of the Sarah Berliner and other research fellowships for women.Women in the 18th and 19th had very difficult times attaining a career in fields such as psychology, physics, and mathematics Due to the lack of women’s rights, their ideas, studies, theories, and works were often unwelcomed. However, despite all powers against Christine Ladd-Franklin, she continued to push on and accomplish exceptional feats. She died in 1930, but her legacy lives on in women psychologist and historians of psychology today.

Describe at least three different ways in which ethnography as a Essay

Describe at least three different ways in which ethnography as a research methodology and - Essay Example The three issues are of great importance to the African countries, because they directly influence the sociopolitical and economic development processes. The position of African women in political environment is a key cultural aspect. As from mid 1980s and early 1990s, women centered bodies have increasingly expanded operations and resources. Thus, women have been given adequate opportunities of illustrating and safeguarding their interests. Women are responsible for the unprecedented increase in the local and national women bodies, and also enhancing networking in the African continent. In majority of African countries, women organizations aggressively utilize the media to create awareness on their rights, in levels that were not seen before the 1980s. In certain African constituencies, women have illustrated their rights in terms of land ownership, property inheritance, and associational autonomy in the legal system. This is a very significant improvement in women welfare, which was rarely realized in the periods before the 1980s. Women leaders and many women organizations in Africa continuously challenge the laws, rules and legisl ations, which do not adhere to the concept of gender equality. Women leadership aims at effectively participating in the affairs of governance, legislation, political parties, non-governmental organizations, and the leadership positions in the private sectors of African countries (Cobbett, 2014). The key leadership positions in these areas were previously a reserve for the male members of the society. Therefore, women have effectively utilized the emerging political openings, which were realized mostly during the 1990s, even though the openings are insufficient and challenging. The second aspect of female activism in Africa is unique from the first activism realized during the early post independence period. The reasons for the changes are diverse as illustrated through; multi-partyism activities,

Portrait of a Women with a Man at a Casement by Fra Filippo Lippi Research Paper

Portrait of a Women with a Man at a Casement by Fra Filippo Lippi - Research Paper Example Also the couple shown is believed to be Ranieri Scolari and Angiola di Bernardo Sapiti. The portrait was painted in 1440 and the couple is recorded to have been married in 1936; therefore the interpretation that the portrait is a commemoration of a wedding is plausible. Barnet asserts that in the formal analysis of portraits, one needs to consider how do the background, the angle of the tilt of the head, the furnishings etc help to develop the overall impression of the figure (2008). When scrutinizing this portrait, one can appreciate that the bride is laden with lavish clothes and jewelry typical of a newly-wedded woman. The laws of Florence required that a woman, unless she was the wife of a foreigner, knight or a doctor, would only wear expensive dresses for a limited period of time (The City Review 2009); therefore a special occasion is shown in the portrait. The overdress has fur lining its edges whereas the underdress has loops of gold embedded in the sleeves. The headdress, se lla, has pearls embellished into it and are also present throughout her dress. The pattern in which they are embedded makes the word lealta, meaning loyalty. The couple glances in an expressionless way although the gazes do not interlock (The Metropolitan Museum of Art 2011). Another interpretation of the portrait is that it may represent the birth of a child.

Muslim Empire In Spain ( Alandalus ) Research Paper

Muslim Empire In Spain ( Alandalus ) - Research Paper Example HISTORY In 711 AD, the Christian chief Julian went and appealed to the governor of North Africa Musa ibn Nusair for his assistance against the tyrannical rule of Roderick in Spain. The Moorish Umayyad army consisting of 7000 troops from North Africa under their Commander Tariq bin Ziyad crossed the state of Gibraltar and gained control over much parts of the Iberian Peninsula. Roderick was killed in the battle and his Visigoth army was defeated. It was the start of an eight year Islamic rule in that region. From the 8th- 15th centuries, various parts of the Iberian Peninsula majorly Southern Spain, Portugal and France were ruled by the Muslims; which were mostly Arab or Berber. PERIOD The Muslim empire in Spain was not under a single reign instead it was a series of different successions made by various Muslim rulers. From 711- 716, the military troops under their leader Tariq ibn Ziyad conquered the region. In 756, the Umayyad prince Abd ar Rahman.I establishes the Emirate of Cordoba. It was a blooming time of the Umayyad dynasty as well as for the Arab culture (BBC, 2009). Later Abd ar Rahman.III took over. The reign of Umayyad dynasty in Spain lasted from 756- 929. Civil wars in 1009 and 1013 totally collapsed the Emirate of Cordoba. As result of this various small states came into being. These states known as the â€Å" Taifas† were divided amongst Arabs, Berbs and Iberian Muslims. As they were weak in military power and thus asked the help of the North African warriors to help fight the Christian kings. From 1080- 1250 Almoravids and then Alhomads ruled. DECLINE In 1212, the Christian states united against the Alhomads . And till 1252 nearly all the Iberian Peninsula came under the three Christian states of Portugal, Aragon, and Castile. The reason of decline of the Muslim empire in Spain was not because the Christians were strong, but it was because the Muslim rulers were cutting each other’s throat and hence was becoming weaker. By the mid thirteenth century the Muslim rule in Spain was limited to a thin mountainous strip of land in the south. In 1230-40 Muhammed ibn Yusuf ibn Nasr founded a state centered around the city of Granada. Granada had a weak economy and had to face internal conflicts as well. Also the Muslims in North Africa at that time, went into decline and could no longer provide Granada their support (Islam & Islamic History, 2001). The Christian States of Castile, Aragon and Portugal united and grew stronger. In 1474, war started and one city after another came to the Christian artillery. In 1492, after an eight-month siege, Granada also became a part of Christian artillery. The Muslims in Spain finally lost all their in 1492.And by 1502, after 800 years the Christians gained power again and issued orders involving Muslims to convert to Christianity, otherwise imposing brutal limitations. The Muslim empire in Spain made various contributions in many fields. During Abd ar Rahman III reign, books from Baghdad (as it was the centre for research back then) were brought to this land. Libraries, hospi tals, Research centers and centre of Islamic studies were established. Scholars, historians, poets and researchers were invited to the region to make their contributions in their respective fields. ACCOMPLISHMENTS IN SCIENCE Science is a very vast field. The Muslim scientists and scholars contributed a

Addiction Essay Example | Topics and Well Written Essays - 1750 words

Addiction - Essay Example Addiction is as a result of many addictive things in the life of a person. For instance, peer pressure is a major contributor to dependency. An individual can abuse a drug or alcohol because one is forced to do so by the group of friends. There are different forms of addiction, and each of addiction poses its series of risks. While alcohol and drug use often begin as voluntary behaviors, addiction prompts chemical alterations in the brain of an individual. It affects memory, behavior, as well as perception of pleasure and pain (Hollander, 2012). If not controlled in time, addiction can have a lot of adverse impacts on the life of an individual. It is, for this reason, individual’s responsibility as well as of the government to control addiction at all cost. It is, for this reason, individual’s responsibility to ensure that one avoids peer influence at whatever cost. Technology is also another factor that can contribute to addiction, and can also be another form of dependency. Once an individual keeps on looking the deeds of other people in other countries will in one way or another distort the mind of a person. Being on the internet every time is also another addiction. However, once a person is affecte d, there will be greater consequences that will significantly affect once lifestyle. Combination of compulsive cravings with prolonged substance abuse can prompt physical consequences in the entire body of an individual (Haugen & Musser, 2013). In addition, the effects of drug addiction can include stress on the organs, respiratory system and venous that can cause a series of physical health issues. Furthermore, medical concerns like depression and anxiety can severely interrupt social and professional life, contributing to mood swings, chronic fatigue and low interest in previous hobbies and significant life events. Apart from the above medical concerns, chronic use of certain substances can result in long-term neurological

HR Management Essay Example | Topics and Well Written Essays - 2500 words

HR Management - Essay Example Even though man material and machine are some of the essential resources needed for an organization, mobilization or effective utilization of these resources is possible only with the help of the human resources. Cross cultural business or international business is growing day by day because of the huge popularity of the globalization, liberalization and privatization policies. All the countries realized the importance of foreign direct investments in their economic growth. Many of the big organizations which faced saturation in their home country are currently trying to exploit the opportunities in international market and as a result of that international business is growing rapidly today. The growth of international business brought many new challenges to organizations and the communication problem is one among them. Human resource management department is responsible for formulating necessary strategies needed to avoid communication problems in international business. Culture and communication plays a vital role in international business and hence the training given to an employee/ manager before an overseas assignment must target cultural and communicational differences between the native country of the employee and the target country. When organizations move into foreign markets they must adapt to communication, culture and human resource issues. Domestic business and international businesses have more differences than similarities. It is easy to start a business in the home country whereas it is difficult to establish a business in a foreign country because of the difficulties in communicating with different stakeholders in the foreign country. This paper briefly analyses different communication problems faced by companies while engage in international business and the HRM strategies needed to overcome it. Before the establishment of business in another country, the entrepreneur must know some basic facts about the target country. The political, social, cultural, legal and economical aspects of the target country could be entirely different from that of his home country. For example, suppose an American company is trying to establish a business unit in China. China is a communist country whereas America is a democratic country. English is the official language of America whereas that of China is Mandarin. The Chinese economy is developing at a much faster rate than that of America. Human rights and freedom of expression are less valued topics in China whereas these things are extremely important in America. There are many other areas in which America and China vary drastically and the HRM strategies should account for all these differences before establishing a business unit in China. David A Victor (2009) has proposed his famous LESCANT model for knowing more about the communication issues in international business. According to him Language, Environment, Social organizations, Contexting, Authority, Nonverbal communication means, Time concepts etc of different countries are different (Victor) In America, English is the official language whereas in China, it is Mandarin. The importance of language in the communication process cannot be neglected while formulating HRM strategies in international context. If communication is the body of an organization, then language is the blood of it. In an organizational set up, communication can take place between the organization and the
